Review of amendments to the legislative acts of Turkmenistan adopted in March
25.03.2023 | 10:12 |President Serdar Berdimuhamedov signed a number of laws on amendments and additions to some legislative acts of Turkmenistan. All the texts of the laws were published in the official Turkmen press. ORIENT provides a brief overview of the amendments.
The Law of Turkmenistan "On the city of Arkadag"
This law establishes the special status of the new center of the Akhal region as a city of national importance. This status is based on the Constitution of Turkmenistan and is determined by a new law.
It is noteworthy that now the city of Arkadag actually acquires the rights of the region. Previously, only the capital of the country, Ashgabat, was granted such rights. This means that the city will be able to independently develop and submit for consideration programs of socio-economic development and a draft budget to the Cabinet of Ministers of Turkmenistan.
In addition, the mayor of the city is personally accountable to the President of Turkmenistan, and not to the head of the region. Heads of city districts are also appointed by the President and are accountable to the Mayor.
All branches, departments, and bodies are formed in direct subordination to the relevant ministries only in coordination with the Cabinet of Ministers of Turkmenistan. This is the first city in the country to have such a status. This highlights the importance of the city in terms of its political significance and economic potential.
Amendments to the Administrative Code of Turkmenistan
The amendments made to the Code of Administrative Offences of Turkmenistan imply tougher penalties for illegal seizure of land for the purpose of harvesting. According to the amendments, now the damage caused in the amount of less than 300 base rates of the base value will be recognized as large.
The changes also affected the article on the intentional destruction or damage of someone else's property. Now a minor damage is recognized as one that does not exceed 30 base rates value. Previously, this threshold was set at 15 base rates.
Recall that the base rate in Turkmenistan is 100 manats.
Amendments to the Law of Turkmenistan "On Shared construction of residential buildings and other real estate objects"
As part of the amendments to this law, an amendment is introduced, which states that local executive authorities have the right to issue a permit to a building company for the construction of a residential building and/or other real estate object only after approval by the Cabinet of Ministers of Turkmenistan. The only exceptions are private houses.
At the same time, the competencies of the executive authorities are significantly expanding. For example, they will determine the subordinate organization that will operate an apartment building after its construction.
In addition, local authorities will now have to coordinate with government agencies applications related to the cost of a standard contract, unit prices of materials used, equipment and construction and installation works.
Amendments to the Law of Turkmenistan "On licensing of certain types of activities"
According to the amendments to this law, Turkmenistan will now license a new type of activity — the production of industrial building materials, products and structures.

Amendments to the Law of Turkmenistan "On Urban Development"
The definition of a simplified project is introduced into the text of this law. A simplified project is a project consisting of a master plan of a land plot allocated for a building, foundation, floors and facades of a residential building.
Also, now the authorized bodies in the field of urban planning will carry out the registration of permits for the construction of facilities. Previously, local executive authorities were engaged in this.
The following amendment states that now a permit for the construction of facilities is issued by a local executive authority only after the authorized body has registered this permit. However, the amendment does not apply to the construction of an individual residential building.
The Law of Turkmenistan "On Accession to the International Convention on the Harmonized Commodity Description and Coding System"
