In accordance with international practice, the number of notaries in Turkmenistan is limited by the Ministry of Justice based on various criteria in order to simultaneously ensure the availability of notary services for all citizens and prevent unfair competition among notaries.
According to the Procedure, in the cities of Ashgabat and Arkadag, there should be 30 thousand people per private notary. In the cities of regional subordination, one notary can work for 25 thousand people, and in etraps — one for 20 thousand people.
Thus, taking into account the results of the population census of Turkmenistan conducted in 2022, about 34 private notaries can work in Ashgabat with a population of more than 1.03 million.
The document also states that, on average, private notaries must perform 300-400 notarial actions per month, and their offices are prohibited from being located outside the scope of their activities — their city or district.
The procedure also provides that the number of private notaries can be determined differently, taking into account the demand, as well as the remoteness from each other of settlements in a particular area.
Notaries are specialists who confirm the validity and reliability of various documents, transactions and other facts. To become a notary, you need to have a higher legal education, work experience in the relevant field and pass a qualification exam.
