
Minister of Construction and Architecture of Turkmenistan Guvanch Orunov signed an order on the inspection of technical, qualitative and aesthetic characteristics of building materials imported into the country. Document has been published on the website of the Turkmen Ministry of Justice.
The order of import and analysis was adopted to determine the feasibility of signing contracts for the import of construction and repair materials to Turkmenistan.
It was developed to prohibit the use of materials that do not comply with the construction standards of Turkmenistan in the construction of various facilities, including social purposes.
The analysis and evaluation of materials will be carried out by the State Department of Methodology, Pricing and Estimates under the Ministry of Construction of Turkmenistan. The rules apply to all importers of building materials, regardless of the form of ownership.
Now a special group formed by the Ministry will be created to determine the compliance of materials with state standards. To do this, you need to submit documents to the Department, where they will be checked for up to 10 working days. Then the Department transfers the documents to the Ministry, where their verification will take up to 3 working days.
Only after that, the Minister signs the order on the formation of the group and the schedule of its work. The Group analyzes the technical, aesthetic, and qualitative characteristics and draws up an appropriate protocol, which is then sent to the Minister for signature.
The following documents are required for submission:
— application for analysis;
— a copy of the constituent documents, the certificate of state registration and inclusion in the State Register (for legal entities);
— a copy of the state registration of an individual entrepreneur and a passport (for individuals);
— the list of building materials agreed between the contractor and the customer;
— a copy of the contract for the supply of building materials;
— a document certifying membership in the UIET (if any).
The Ministry of Construction may file a refusal in the following cases:
— failure by the applicant to submit missing documents;
— the presence of incorrect or deleted information in the submitted documents;
— fixing violations of the rules for placing a purchase order;
— non-compliance of construction and repair equipment with the construction standards of Turkmenistan;
— the specified price of the goods at the time of submission of documents was higher than the average market price;
— non-compliance of documents with this provision.
In the analysis, the Group studies the following:
— certificates of conformity of the country of origin of the goods;
— product ratings in various sources, including on the Internet;
— commercial proposals submitted to the Ministry;
— increase and decrease in demand for the corresponding goods;
— compliance of construction and repair equipment with technical state standards;
— compliance of the product with national characteristics and local climatic conditions;
— Incoterms 2020 (international trade rules);
— type and condition of payment;
— terms of delivery;
— purchase volume;
— conformity of the place of origin of the goods in the signed contracts;
— warranty documents;
— price compliance with market prices depending on the situation of price conjuncture on the world market;
— additional agreements.
