Procedure for establishing protected zones of railway transport of Turkmenistan was approved

The procedure for establishing protected zones for railways and other railway transport facilities was approved by the decree of the President of Turkmenistan. The document was signed on Friday, at a meeting of the Cabinet of Ministers of the country, on the proposal of the Director General of the Agency for Transport and Communications under the Cabinet of Ministers Mammetkhan Chakiev.The procedure for establishing protected zones for railways and other railway transport facilities was approved by the decree of the President of Turkmenistan. The procedure for establishing protected zones for railways and other railway transport facilities was approved by the decree of the President of Turkmenistan. The document was signed on Friday, at a meeting of the Cabinet of Ministers of the country, on the proposal of the Director General of the Agency for Transport and Communications under the Cabinet of Ministers Mammetkhan Chakiev.

According to the law of Turkmenistan "On Railway Transport", protected zones are territories that are adjacent on both sides to the right of way and within which a special regime for the use of land is established in order to ensure the safety, strength and stability of railway transport facilities, including those located on areas with moving soil and areas subject to sand drifts and other harmful effects.

Protected zones are established in order to ensure the safe operation of railways and other railway transport facilities, as well as the safety of the population, railway workers and passengers in places prone to landslides, slips, erosion, mudflows and other negative impacts.

For example, for land plots within protected zones, a special land use regime is established, under which the owners, users or tenants of these land plots have the right to their economic use with the following restrictions:

– it is prohibited to conduct industrial and civil construction;

– it is prohibited to perform any work without the consent of the authorized body;

– Railway transport enterprises within the protected zones have the right to carry out work on the repair and maintenance of railway transport facilities, as well as work to eliminate the consequences of accidents with prior notification of the owners, users or tenants of these land plots and subsequent compensation for damage in accordance with the legislation of Turkmenistan.
